Customer vs. Client (Important Distinction)

In Idaho, the duties a brokerage owes to you depend on whether you are a Customer or a Client. A Client relationship is created only by signing a written representation agreement. Customer-level services and client-level duties are different, and confidentiality/advocacy protections generally apply at the Client level.

Types of Representation in Idaho

  • Single Agency: The brokerage represents you, and only you, in the transaction and cannot represent the other party.
  • Limited Dual Agency: The brokerage represents both the buyer and the seller in the same transaction. Idaho recognizes limited dual agency structures, including versions where clients may have assigned agents and versions without assigned agents, depending on the brokerage’s structure and the written agreements in place.

Confidentiality & Negotiation Limits in Limited Dual Agency

If a brokerage represents both parties as a limited dual agent, Idaho law restricts the brokerage from advocating for one client over the other and limits the disclosure of certain confidential information unless there is written permission from the client who owns that information. This is one of the reasons it is important to understand the agency relationship before you share strategy, motivation, or sensitive details.
